We Are Here, Inc. (“We Are Here”, “we”, “us”, our”) provides online products and services (collectively, the “Services”) through our mobile applications and wearehere.com (collectively, the “Site”) that may, among other things, provide you with tools to engage in supportive care assistance for those facing cancer, their caregivers and their support team. We provide this privacy policy (“Privacy Policy”) to describe the information We Are Here collects from users of the Site (“Users”,“you”), how that information is stored, how we use that information, what information other members can see when they use the Site and how We Are Here Partners (defined below) receive data and how we may use and disclose this information when the Site is accessed through any device. It also describes the choices available to you regarding our use of your information and how you can manage and update this information. Some online services offered by or affiliated with We Are Here may be governed by a separate privacy policy. We suggest you review each of the privacy policies for the services you are wishing to receive.

For the purpose of this Privacy Policy, “Personally Identifiable Information” means any information that, by itself or in combination with other information, identifies or can reasonably be used to identify an individual, such as name, email address, telephone number, address, or date of birth. Personally Identifiable Information does not include information that is anonymized, or publicly available information that has not been combined with non-public Personally Identifiable Information.

When you sign up or use We Are Here, we ask you to confirm that you’ve read and agree to our Privacy Policy. This means that by submitting Personally Identifiable Information and other information to the Site, you consent to the collection, use, and disclosure of such information as set out in this Privacy Policy.

Generally, you may browse the Site and/or our applications without providing any Personally Identifiable Information. However, we ask that you provide information at various times and locations through the Site. In certain components of the Site, you may also provide certain medical information that may be protected under applicable laws. We Are Here is neither a “covered entity” nor a “business associate” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”). It is important to remember that, while state-specific privacy laws may apply, HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with We Are Here.

Scope of This Privacy Policy; Enterprise Users. This Privacy Policy governs your relationship with We Are Here when you access the Site or the Services directly, including where you sign up on your own or through a referring organization such as a patient advocacy nonprofit. If you access the Services through an organization — such as a hospital, health system, employer-sponsored health program, health plan, or care navigation provider — that has entered into a Business Associate Agreement (“BAA”) with We Are Here regarding your health information, that organization’s own notice of privacy practices, and the BAA between We Are Here and that organization, will govern We Are Here’s use and disclosure of your health information to the extent addressed therein, and will control over this Privacy Policy in the event of a conflict. This Privacy Policy continues to apply to any use or disclosure of your information not addressed by that organization’s notice or the BAA. The preceding paragraph describing HIPAA’s applicability to We Are Here describes your direct relationship with We Are Here; where you access the Services through an organization with a BAA in place, We Are Here acts as that organization’s business associate or subcontractor with respect to your health information.

Any medical or health information that you provide that is subject to specific protections under applicable state laws will be used and disclosed only in accordance with such applicable laws. However, any information that is not protected under such applicable state laws may be used or disclosed in any manner permitted under our Privacy Policy.

Information you store on your Profile:

We collect information you provide when you sign up with We Are Here, including your email address. We may also collect any optional information from time to time you may choose to provide (i.e. full name, address, phone number, diagnosis, etc.) When you create a Support Team, we may collect identifying information about members of the Support Team and the caregiver, such as the caregiver’s work status and living situation. We also collect information about how supporters can help patients. We may use this information to suggest services that may be of use to the patient or caregiver and, with your consent, apply for and/or enable those services on your behalf. When you use our coaching services, we arrange 3rd party coaching services and/or you use Peer Guidance and navigation services, we may collect information regarding your past and present medical history (i.e., diagnosis, medical events, medications, etc.). We may also collect financial information in order to determine eligibility for certain programs and benefits. Finally, we may collect information regarding your insurance coverage and benefits.

Why do we ask you for certain types of information?

Recommended services and products often depend on criteria such as diagnosis, mental health and physical health. This data helps us to provide you with a personalized online experience.

How do we use your information?

We will use your information only for the following purposes:

to provide, improve and create new services by We Are Here;
to respond to your inquiries;
to send you administrative communications about the Site;
to detect and defend against fraud and other threats to the Site and our users;
to administer your account;
to obtain your feedback about the Site and We Are Here’s services;
to send you electronic messages and emails, including news, announcements, reminders and opportunities from We Are Here;
to process, fulfill, support, and administer transactions and orders for products and services ordered by you;
to contact you in response to a request;
to administer quizzes, surveys, and sweepstakes;
to fulfill any other purpose for which you provide it; (for example, applying for and/or enabling 3rd party services)
to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
to notify you about changes to our Site, or any products or services we offer or provide though them; in any other way we may describe when you provide the information;
and for any other purpose with your consent.

Information regarding the care recipient’s needs, actions taken and updates may be shared among and be available to Care Team members, but is not publicly visible to other Users outside of the Care Team without the care recipient’s written consent.

We may also use your information to contact you about goods and services that may be of interest to you, including through newsletters. If you wish to opt-out of receiving such communications, you may do so at any time by clicking unsubscribe at the bottom of these communications.

Creation and Use of Combined Data, De-Identified Data, and Aggregated Data:

As permitted by law and by We Are Here’s agreements with applicable We Are Here Partners, Here, and any third-party vendors acting on We Are Here’s behalf, may aggregate and/or de-identify your Information and/or combine your Information with other information maintained or available to We Are Here and use or disclose such information as follows:

We may use aggregated or combined data to communicate with you about the Site and/or our products and services and disclose such aggregated or combined data to We Are Here Partners in connection with providing the Site.
We may also use and disclose de-identified data, de-identified aggregated data, and/or de-identified combined data for any business purpose, which may include, without limitation, improving our products and services, conducting analytics such as evaluating our Site and developing additional benefits, programs, and services, and disclosing to We Are Here Partners for analytics purposes.

De-Identified Data License. Any information that has been properly de-identified in accordance with the HIPAA Privacy Rule’s de-identification standard (45 C.F.R. § 164.514(a)–(c)), whether or not HIPAA independently applies to your relationship with We Are Here, is no longer considered your personal information. You grant We Are Here a perpetual, irrevocable, worldwide, royalty-free license to use, retain, aggregate, analyze, modify, create derivative works from, and disclose such de-identified information for any lawful business purpose, including analytics, research, product development, and training of algorithms and machine-learning models. This is a license, not a transfer of ownership.

Use of Your Own Coded Information to Personalize Recommendations. If the Services provide personalized resource or care-navigation recommendations, We Are Here uses information associated with an auto-generated identifier (rather than your name or street address) to generate and adapt recommendations for you. This coded information is used only to adapt recommendations shown to you, and is not used to influence recommendations shown to any other individual. We Are Here maintains access controls so that personnel who build or maintain the recommendation system do not have the separate access needed to identify you from this coded information.

Resource Status Information. We Are Here maintains a catalog of external support resources and may determine or update a resource’s availability, funding status, or general helpfulness from (a) automated or manual review of information the resource itself has made publicly available, which does not involve your personal information, and/or (b) feedback volunteered by users like you about a resource. Feedback described in (b) is aggregated across users before being used to update the shared catalog, so that no individual’s feedback or health condition can reasonably be identified from the resulting information about a resource.

SMS/MMS

We may use your telephone number for the purpose of sending you SMS messaging related to the services we provide, marketing messages, and other purposes if you have opted in to receive such messaging. Messaging will be sent by an automated system initiated by our third party messaging provider. We do not share your telephone number with third parties for the purposes of receiving third party marketing messages. Disclosure of Information

We may share your Information in the following circumstances:

Disclosures to Service Providers and We Are Here Partners: With the limited exceptions discussed in this policy, we do not share your information with third parties, unless you tell us to. We will not share your personal information under any circumstance with any third parties for the purpose of allowing them to conduct direct marketing to you. No mobile information will be shared with third parties / affiliates for marketing / promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. With Third Parties That Provide Requested Benefits: As stated above, we primarily share your information, including your personal information, with third parties for the purpose of providing certain benefits that you request. Specifically, at your direction, we will submit your information to the appropriate third parties for purposes of filling your third-party service requests. For example, if you are interested in cleaning or nutrition services, then we will share your information, at your direction, with third parties that work with We Are Here to provide cleaning or nutrition services, which may fit your particular needs.
The third party, not We Are Here will evaluate your eligibility to obtain service from its program. The third party’s use of your personal information will be governed by the third party’s own terms of service and privacy policy, not We Are Heres; We Are Here does not have any control over your information once it is submitted to a third party for receipt of service. While we work with reputable third-party service providers, we cannot represent how any of them will use your personal information in connection with their services, and recommend that you review their terms of use and privacy policies before requesting their services.
To Perform Services on Our Behalf: We may hire vendor companies to provide limited services on our behalf, such as payment processing, sending postal and electronic mail, providing technical support, and to assist us in providing the products and services that you request from us. We only provide those service providers with the information necessary to perform the requested service.

Children:

Our Site and/or Apps are not intended for children and adolescents under 18 years of age. No one under age 18 may provide any information to us through the Site. We do not knowingly collect Personally Identifiable Information from individuals under 18. If you are under 18, do not access, use, or provide any information on the Site or on or through any of its features. If we learn we have collected or received Personally Identifiable Information from an individual under 18 without verification of parental consent, we will delete that information. Cookies:

A “cookie” is a data element that a website can send to your browser, which may then be stored on your system. We use different kinds of cookies on the Site. They may help store user preferences and activity, and may allow a website to recognize a particular browser or device.

Third- Party Sites:

Our Site may contain links to other third-party sites. When you click on one of these links you are visiting a website operated by someone other than We Are Here, and the operator of that website may have different privacy policies. We Are Here is not responsible for the individual privacy practices of those sites. We encourage you to investigate the privacy policies of these third-party operators.These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Retention of Personal Data:

Personal data will be retained only for so long as reasonably necessary for the purposes set out in this Privacy Policy, considering criteria such as applicable rules on statute of limitations and at least the duration of your use of our Site and Services. Information may persist in copies made for backup and business continuity purposes for additional time.

You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. We reserve the right to change this Privacy Policy at any time. Changes are effective as of the date posted, and, to the extent permitted by applicable law, will apply upon your next use of the Site or the Services following posting. The applicable version of this Privacy Policy is available on the Site. Where applicable law requires your affirmative consent before a change takes effect — for example, consent to a new purpose for using your consumer health data under an applicable state law — we will obtain that consent before the change applies to you, notwithstanding the foregoing.
